My query about whether or not a schema was required was not related to whether or not the user wanted to *validate*, but was concerned with the infoset modifying behaviour of schemas.

So, say your schema defines a default value for a copyright attribute.

Wouldn't the Custom XML implied differ according to whether such a schema is in effect of not? So it's not just a question of validation, but of modification of the instance.

This assumes that OOXML has a coherent story to tell about defaulting in schemas when they govern these customised vocabularies. Does it? This very much bears on whether "can" is the right word here. How can a user know whether the implied XML has been transformed by the validation process?

[Long term such problems would be solved by using RNG as the governing schema in such circumstances, but that's probably a longer term goal]
